Copyright and DMCA Policy

MyStdio, a product of Zyon Entertainment Pty Ltd (ABN 24 640 498 997, 383 Pitt Street, Sydney NSW 2000, Australia) (we, our or us), respects the intellectual property rights of others and expects users of our website and Client Portal (Platform) to do the same. Because the Platform hosts user-submitted content that is accessible to an audience in the United States, we have adopted the notice-and-takedown procedure set out below in order to comply with the safe harbour provisions of the United States Digital Millennium Copyright Act, 17 U.S.C. Section 512 (DMCA), and to respond to equivalent copyright complaints made under other applicable laws.

This policy describes how a copyright owner (or an agent authorised to act on a copyright owner's behalf) can notify us of alleged copyright infringement appearing on the Platform, and how a user whose content has been removed can respond with a counter-notification. This policy applies in addition to, and does not limit, our Terms of Use, which govern your use of the Platform generally.

Scope of This Policy

This policy applies to material uploaded, posted, or otherwise made available on the Platform by users, including (without limitation) video files, images, documents, and comments. It does not extend the rights of any party beyond what is provided under applicable law, and nothing in this policy is intended to constitute legal advice.

How to File a Takedown Notice

If you believe, in good faith, that material available on the Platform infringes a copyright you own or control, you (or your authorised agent) may submit a written notice of claimed infringement to our designated DMCA agent (see below). To be effective under 17 U.S.C. Section 512(c)(3), your notice must include substantially all of the following:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the copyright that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online location are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, a URL or a description of where on the Platform the material appears).
  4. Information reasonably sufficient to permit us to contact you, such as your name, postal address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.

A notice that does not substantially comply with these requirements may not be actioned. We encourage you to seek independent legal advice before submitting a notice, as it is a legal document and knowingly making a material misrepresentation in a notice may result in liability for damages.

What Happens After We Receive a Notice

On receipt of a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the identified material, and will make reasonable efforts to notify the user who posted the material that it has been removed or disabled and why.

Counter-Notification

If material you posted to the Platform was removed or disabled in response to a takedown notice and you believe the material was removed in error or as a result of misidentification, you may submit a counter-notification to our designated DMCA agent (contact details above). To be effective, your counter-notification must be a written communication that includes substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared on the Platform before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of that person.

Upon receipt of a valid counter-notification, we may, in our discretion and as required by applicable law, provide a copy to the person who submitted the original takedown notice. If that person does not notify us within a reasonable time that they have filed an action seeking a court order to restrain the user from engaging in the infringing activity, we may reinstate the removed material at our discretion.

Repeat Infringers

We will, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who are determined to be repeat infringers of the intellectual property rights of others. A repeat infringer is a user who has been the subject of more than one valid takedown notice under this policy.

False Claims and Misuse of This Process

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Do not submit a notice or counter-notification unless you are certain the information in it is accurate and, where applicable, that you are authorised to act on behalf of the relevant rights holder.
