Acceptable Use and AI Policy

This Acceptable Use and AI Policy (Policy) forms part of the Terms of Use that govern your access to and use of the website and Client Portal (Platform) operated by MyStdio, a product of Zyon Entertainment Pty Ltd (ABN 24 640 498 997, 383 Pitt Street, Sydney NSW 2000, Australia) (we, our or us). This Policy applies to all users of the Platform, and to all content, data, and material that any user uploads, generates, stores, or shares on or through the Platform (Content). Capitalised terms not defined in this Policy have the meaning given to them in the Terms of Use.

By accessing or using the Platform, you agree to comply with this Policy. A breach of this Policy is a breach of the Terms of Use.

Prohibited Uses

You must not use the Platform, and must not permit any other person to use the Platform, to do any of the following:

  • Engage in, promote, or facilitate any illegal activity, or upload, store, or share any Content that is illegal or that violates the rights of any third party.
  • Infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, moral right, or other intellectual property or proprietary right of any person.
  • Upload, transmit, or introduce any virus, malware, ransomware, worm, trojan horse, or other malicious or harmful code, file, or script.
  • Harass, bully, threaten, defame, or abuse any person, or upload or share hateful, discriminatory, obscene, or otherwise objectionable Content.
  • Attempt to gain unauthorised access to the Platform, any account, or any system or network connected to the Platform, or otherwise attempt to breach, circumvent, or test the security or authentication measures of the Platform.
  • Scrape, crawl, harvest, or otherwise extract data from the Platform using automated means, or take any action that imposes an unreasonable or disproportionately large load on the Platform's infrastructure.
  • Misrepresent your identity or affiliation with any person or entity, or impersonate any person, business, or organisation.
  • Violate the privacy, publicity, or personality rights of any person, including by uploading or sharing another person's personal information, image, or likeness without a lawful basis or their consent.
  • Send, distribute, or facilitate unsolicited bulk communications, spam, or phishing messages using the Platform.

Your Responsibilities for Content You Upload

You are solely responsible for all Content that you upload, submit, or otherwise make available through the Platform. By uploading or submitting Content, you warrant that:

  • you own the Content, or you have obtained all necessary rights, licences, consents, and permissions to upload, use, and share the Content on and through the Platform; and
  • the Content does not, and its use in connection with the Platform will not, infringe or violate the intellectual property rights, privacy rights, or publicity or likeness rights of any third party.

We do not review all Content before it is uploaded or shared, and we are not responsible for any Content uploaded by users. If we become aware of Content that breaches this Policy, we may take the actions described under "Consequences of Breach" below.

AI Features and Transparency

The Platform offers certain features powered by third-party artificial intelligence providers, including image generation, text generation and analysis, video analysis, and audio transcription (together, AI Features). This section explains how AI Features work and the rules that apply to their use.

Labelling of AI-Generated Content

Images, video, and text generated using AI Features are labelled as AI-generated where required by applicable law, including Article 50 of the EU Artificial Intelligence Act. For example, storyboard frames shared for client review display an on-page AI-generated label, and posts published to supported social platforms carry that platform's own AI-content disclosure where the platform offers one. Some AI providers may embed content credentials (such as C2PA metadata) in their outputs; we do not currently verify or guarantee that such credentials survive our image-processing pipeline.

Prohibited Uses of AI Features

You must not use any AI Feature to:

  • create realistic content that depicts a real, identifiable person without that person's consent; or
  • create misleading or deceptive "deepfake" content, or any content intended to falsely represent that a real person said or did something they did not say or do,

in each case consistent with, and subject to, the usage policies of our AI providers, which apply to your use of AI Features in addition to this Policy.

No Warranty on AI Outputs

AI Features use third-party, probabilistic AI models. Outputs generated using AI Features (including images, text, video analysis, and transcriptions) may be inaccurate, incomplete, or unsuitable for your intended purpose. AI outputs are provided on an "as is" basis and without warranty of any kind, to the extent permitted by law (including the Australian Consumer Law). You should review and verify any AI output before relying on it, publishing it, or sharing it with others.

Your Responsibility for AI Outputs

You are responsible for ensuring that your use of any AI output complies with applicable law and does not infringe the intellectual property (including trademark), privacy, or publicity rights of any third party. You must not rely on an AI output as a substitute for your own legal, compliance, or editorial judgement.

Consequences of Breach

If we reasonably believe that you have breached this Policy, we may, at our discretion and where practicable with notice to you (subject to any rights that cannot be excluded by law), take any of the following actions: remove or disable access to the relevant Content; suspend your access to the Platform, in whole or in part; or terminate your account. We may also take any other action reasonably necessary to protect the Platform, our users, or third parties from harm.
